Agreement
By accessing or using the CloudMetis platform ("Service"), you agree to be bound by these terms. If you do not agree, do not use the Service.
Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials and API keys.
- You must notify us immediately of any unauthorised use of your account.
- One organisation per account. Sub-accounts may be created for team members.
SMS Services
- SMS messages are sent through third-party delivery partners. We do not guarantee delivery to every recipient.
- You must comply with Kenyan telecommunications regulations, including the Communications Authority of Kenya guidelines on bulk SMS.
- You must not use the Service to send spam, fraudulent messages, or messages that violate any law.
- You must include opt-out instructions in marketing messages where required by law.
- Sender IDs are subject to approval by the mobile network operators.
Billing and payments
- The Service uses a prepaid wallet model. You must have sufficient balance to send messages.
- SMS pricing is as published on our pricing page. We may update prices with 30 days' notice.
- Failed messages are not charged. Successfully delivered and sent messages are charged.
- Wallet balances are non-refundable except at our discretion.
API usage
- API access is provided with your account. API keys must be kept confidential.
- You must not exceed reasonable usage limits. We may throttle or suspend accounts that abuse the API.
- We may change the API with reasonable notice. Breaking changes will be communicated in advance.
Acceptable use
You must not use the Service to:
- Send unsolicited messages (spam)
- Send messages containing illegal, harmful, or offensive content
- Impersonate any person or organisation
- Interfere with the operation of the Service
- Attempt to access other users' accounts or data
Termination
We may suspend or terminate your account if you violate these terms. You may close your account at any time by contacting us.
Limitation of liability
The Service is provided "as is". We are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
Governing law
These terms are governed by the laws of Kenya. Disputes will be resolved in the courts of Nairobi, Kenya.
Changes
We may update these terms from time to time. Material changes will be communicated by email or through the platform. Continued use after changes constitutes acceptance.
